(READ IN CONJUNCTION WITH THE

GUIDE FOR ASSESSMENT 3
PROVIDED ON MOODLE)

TOPIC

IRAC, show how the following common law cases may be analysed in order to
understand the principles of law developed in a case and how they are then
applied to similar fact situations.

Donoghue v Stevenson 1930 – (commonly called
the ‘snail in the bottle case’) –
negligence associated with product liability (harmful goods). Case here> (http://casebrief.wikia.com/wiki/Donoghue_v_Stevenson)

2.
Hadley v Baxendale
1854
– the issue of foreseeability in the determination
of damages in contract law. (http://www.lawnix.com/cases/hadley-baxendale.html)

3.
Shaddock v Parramatta
City Council 1982
– negligence associated with misstatement
(wrong advice) (http://www.austlii.edu.au/au/journals/FedLRev/1982/6.pdf)

Source
of Materials:

significant number of students do not have the recommended text book, students
are directed to the summaries of each case given at the links above. These summaries are more than adequate for
the purpose of this exercise, however students may also use other relevant
texts to which they have access.

Student’s

Please put your name, student
